The lawyer of a Brampton, Ont., family whose one-year-old son burned his feet on ground-level metal access doors earlier this summer is now investigating the incident as the family is seeking legal action.
According to a Globalnews.ca report, the boy suffered second-degree burns to his feet and a minor burn to one of his hands after stepping on a nearby grate that protects the controls for the water jets at the Gellert Community Park splash pad in Georgetown, Ont.
“This was an inherent danger at this splash pad,” personal injury lawyer Adam Halioua said in the report. “There was a responsibility to take greater precautions to ensure the safety of all people attending the splash pad, particularly young children.”
The family is suing the town of Halton Hills, as the splash pad is in the jurisdiction of the township. Other parties will also be named in the lawsuit if they were involved in the design of the splash pad which opened in 2000.
The amount of the suit was undisclosed as it is contingent on the degree of the toddler’s injuries and the length of recovery. The child was treated at The Hospital for Sick Children in late July and doctors continue to monitor his feet throughout the healing process.
It was also stated in the report that the family hopes other towns and regions in Ontario take note of what happened and make appropriate changes before another child is injured.
