An Ontario judge has found Ottawa’s Calypso waterpark guilty on six of 11 safety-related charges under Canada’s Technical Standards and Safety Act (TSSA), dating back to 2011.
According to a CTVNews.ca report, the judge also said waterpark administrators did not report problems immediately and should have closed the rides for inspection until they were safe to reopen. Two violations were based on lack of operator knowledge and training at the Bobsleigh waterslide. According to the court, it ruled Calypso operated this ride in an unsafe manner.
Lawrence Greenspoon, Calypso’s lawyer, told CTVNews.ca that all necessary safety improvements were implemented after the incidents.
“We’re talking three years ago, and I can assure you that the training and experience of the people operating that ride has been dramatically improved,” Greenspon said in the report.
The Calypso waterpark faced 20 TSSA violations; however, nine charges were dropped in court in February. The waterpark will face sentencing for the six charges on June 12.
Civil lawsuits from patrons who allege they were injured at the waterpark are still pending.
