Residential pool heaters may be added to Canada’s Energy Efficiency Regulations, as part of a three-year Natural Resources Canada (NRCan) regulatory initiative.

In an effort to fight climate change, Natural Resources Canada (NRCan) is proposing a series of amendments to the Energy Efficiency Regulations, under the Energy Efficiency Act, which could impact residential and commercial pool and hot tub products.

As part of this initiative, between 2016 and 2018, Natural Resources Canada will put forward three amendments to improve energy efficiency standards for consumer and commercial products and reduce regulatory burden through alignment with the United States, and collaborating with North American partners, provinces, and territories.

The pre-publication date for the third proposal (amendment 15) is set for spring 2018 and, subject to ongoing consultations with stakeholders, 18 new product categories are being considered for inclusion. Pool heaters have been added under residential products, while boilers, furnaces, water heaters, and industrial pumps are up for review in the commercial and industrial sectors. A final list is expected to be published this fall.

The dates for final publication will depend on the number and nature of comments received during a 75-day comment period after pre-publication. Products described in these updates and the timing of publication is subject to decision-making authorities under the Energy Efficiency Act.

As each proposed amendment may have business impacts, the ‘one-for-one’ rule and/or the small business lens may apply. For more information on the Government of Canada’s Forward Regulatory Plan, visit www.nrcan.gc.ca/energy/regulations-codes-standards/18318[2].
